RE: The tariff classification of catnip-infused paper from China

Dear Mr. Croix:

In your letter dated December 21, 2010, you requested a tariff classification ruling.

The ruling was requested on an item designated as “Catnip Crumples”. The item is a soft cover booklet that contains approximately thirty sheets of catnip oil-infused paper. The thirty white sheets of paper which measure approximately 2¾ inches (w) x 2½ inches (l) are bound together at the top by an adhesive strip. The sheets are made with recycled fibers and organic catnip. The sheets of paper are to be removed from the adhesive strip, crumpled up and tossed around for cats to play with as a pet “toy”.

The applicable subheading for the catnip oil-infused paper will be 4811.60.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Paper, paperboard, cellulose wadding and webs of cellulose fibers, coated, impregnated, covered, surface-colored, surface-decorated or printed, in rolls or rectangular (including square) sheets, of any size, other than goods of the kind described in heading 4803, 4809 or 4810: Paper and paperboard, coated, impregnated or covered with plastics (excluding adhesives): Paper and paperboard, coated, impregnated or covered with wax, paraffin, stearin, oil or glycerol: In strips or rolls of a width exceeding 15 cm or in rectangular (including square) sheets with one side exceeding 36 cm and the other side exceeding 15 cm in the unfolded state: Other. The rate of duty will be free.

You have asked whether this product is subject to antidumping duties or countervailing duties (AD/CVD).
